Hearings scheduled on proposed Legislative rule revisions

 

The West Virginia Department of Environmental Protection, this week, will conduct public hearings for a number of the agency’s proposed 2015 Legislative Rule revisions. Hearings will take place at DEP headquarters in Charleston, 601 57th St. S.E.

On Thursday, July 24, oral and written comments will be accepted beginning at 6 p.m., first for proposed revisions
to Legislative Rule 33CSR20 “Hazardous Waste Management System” and then for proposed revisions to Legislative Rule 47CSR30 “WV/NPDES Rule for Coal Mining Facilities.” The proposed revision to 33CSR20 will incorporate current Federal Hazardous Waste Regulations, including the authorization of the use of electronic manifests in the state of West Virginia when the system becomes available at the federal level. The revision to 47CSR30 is being proposed as a result of the passage of Senate Bill 615 during the 2012 Legislative session and to be consistent with Section 402(k) of the federal Clean Water Act.

On Friday, July 25, oral and written comments will be accepted beginning at 6 p.m. for proposed revisions to Legislative Rule 60CSR4 “Awarding of West Virginia Stream Partners Program Grants Rule.” The proposed revision will remove the restriction of in-kind match and volunteer labor to be valued only at minimum wage. The proposed change will not involve additional costs to the program or the grant recipients.
