Air Quality Fees

Annual renewals for CESs and CTOs will be mailed to subject sources
on June 30, 2017, and must be returned by July 31, 2017.

*Failure to pay the full amount by July 31, 2017 will result in
penalties/late fees of 5% per month, beginning on August 1*

Certified Emission Statement (CES) Invoices – Major and Deferred Title V Sources under 45CSR30

  • The Title V/CES Invoice fee beginning on July 1, 2017 and lasting until June 30, 2018 is $49.67 per ton of regulated air pollutant emitted.

 

  • Title V Major Sources will receive a pre-populated invoice based on their reported SLEIS emissions inventory information with the amount due calculated.

 

  • Title V Deferred Sources will receive an invoice that will require emissions information to be written on the form and the amount due to be calculated by the source.

     

    *The DAQ plans to have Title V deferred sources begin reporting facility emissions in SLEIS in 2018 (for calendar year 2017 emissions).

     

  • Particulate matter emissions must include both condensable and filterable emissions.For more information on condensable particulate matter, please visit the DAQ’s Emissions Inventory webpage:

  • Emissions from all sources at the facility are to be counted, including point source, fugitive, and accidental releases.Total emissions should be rounded to the nearest ton.In determining fees, actual emissions of each regulated pollutant more than 4,000 tons per year are to be reported, but fees are capped at 4,000 tons per pollutant.

 

  • CES fees are determined based on the greater of the following:
    • Total actual emissions (in tons) during the previous calendar year, multiplied by the current fee per ton ($49.67/ton), OR
    • The facility/source category fee from 45CSR22 as listed on the CES invoice as the minimum fee.

       

  • CES Invoices must be signed in blue ink by a Responsible Official (as defined in 45CSR30) or a delegated authorized representative.To delegate an authorized representative, please enclose a completed Authority of Corporation Form when payment is submitted.

     

  • Please return the total amount due and the entire original invoice to the following address:

  • A Title V receipt cannot be issued unless DAQ receives a complete CES Invoice package consisting of the following: 
    • Completed original CES Invoice – both upper and lower portions of the form
    • Signature (in blue ink) of the Responsible Official or delegated authorized representative
    • Authority of Corporation Form if one has not been previously submitted for that authorized representative
    • Fee payment

 

  • Corrections to facility information can be made on the returned form or by e-mailing changes to AirQualityFees@wv.gov

Certificate to Operate (CTO) Invoices – Non-Title V sources

  • CTO fees are determined based on the facility/source category fee from 45CSR22.

     

  • Please return the total amount due and lower portion (payment coupon) of the original CTO invoice to the following address:

    *Please note the change in payment mailing address.  Payments must be sent to the PO Box listed above and not submitted directly to the DEP/DAQ headquarters office.

     

  • Please retain the upper portion of the invoice for your records.It is no longer necessary to return the upper portion to the Division of Air Quality.

     

  • Corrections to facility information can be made by e-mailing changes to AirQualityFees@wv.gov
